MIGAAL COUTURE

MIGAAL COUTURE undertakes to protect the privacy of Users and Customers using the Site by complying with the laws and regulations in force and in particular Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms ("the Data Protection Act") and European Regulation 2016/679 of April 27, 2016, which came into force on May 25, 2018, on the protection of individuals with regard to the processing of personal data and on the transfer of such data (hereinafter referred to as "the GDPR").

MIGAAL COUTURE undertakes to collect and Process Personal data fairly and lawfully.

In this respect, MIGAAL COUTURE ensures that the User or Customer (natural person) concerned by the Processing is informed of the purpose of the Processing, the length of time that the Personal data processed will be kept, the person responsible for the Processing and the recipient of the Processing.

MIGAAL COUTURE undertakes to take the necessary measures to guarantee the security of the Personal data it has collected and to prevent their disclosure to unauthorized third parties.

This Privacy Policy is an integral part of the General Terms and Conditions of Use and Sale.

Applicable from August 1er 2024.

1. DEFINITIONS

Account: refers to the customer account created by the User with MIGAAL COUTURE via the Site.

After-sales services: refers to the services offered by MIGAAL COUTURE from the Site, solely to its Customers who have purchased a Product.

Customer: designates any natural person acting for purposes that do not fall within the scope of his or her commercial, industrial, artisanal, liberal or agricultural activity, as well as any legal entity not acting in professional purposes, having created an Account and accepted MIGAAL COUTURE's Terms and Conditions.

MIGAAL COUTURE: refers to Mrs Magali Vignas (trading name MIGAAL COUTURE) registered as a sole trader under number 909 320 624 and whose registered office is located at Bâtiment A, 115 Boulevard de Ménilmontant 75011 Paris.

Personal data: any information that directly or indirectly identifies a natural person.

Product: designates all products available for sale on the Site.

Processing: refers to any operation, or set of operations, involving Personal data, whatever the process used.

Site: designates the MIGAAL COUTURE website accessible via the following link <migaal.com>.

Supplier: designates all persons, independent of MIGAAL COUTURE, working with MIGAAL COUTURE, in order to offer Products for sale.

User: refers to any visitor to the Site, whether a professional or an individual, whether or not a customer of MIGAAL COUTURE.

2. COLLECTION OF PERSONAL DATA

2.1 Collected data

MIGAAL COUTURE collects Personal data when Users use its Site and more specifically when:

The User creates an Account or modifies Account settings;

The User places orders for Products or geo-locates;

The User may contact MIGAAL COUTURE directly by e-mail, telephone or post.

In the course of browsing the Site, the User or the Supplier may be asked to communicate personal information to MIGAAL COUTURE, including date of birth, postal address, telephone number, e-mail address, bank details, IP address, date, means of payment, total browsing time and origin, and gender.

In the context of orders, MIGAAL COUTURE also processes the following data: time of order and information relating to the User's device (device identifier).

The User has the option of providing his own contact details and delivery address, either manually by entering an address, or by transmitting his GPS coordinates.

MIGAAL COUTURE collects and processes the Personal data of the User for the following purposes:

Knowing and understanding their needs;

Check their identity;

Prepare and send orders;

Manage its commercial relationship with the User;

Respond to the User's requests and solicitations;

Handle questions or requests for information received by post and/or e-mail and/or telephone;

Produce and analyze statistical data in order to analyze and improve the use, security and performance of the Site;

Dealing with system errors;

To communicate commercial offers, targeted information or advertising to the User;

To communicate information to the User by sending commercial emails to his/her electronic mailbox.

2.2 Users under 15 years of age

MIGAAL COUTURE's Products are only accessible to persons over the age of 15 who are able to consent to the Processing of their Personal data.

Also, MIGAAL COUTURE does not collect any Personal data from persons under the age of 15.

However, if a person under the age of 15 wishes to place an order, he or she may access the Site under the responsibility of his or her legal representative.

MIGAAL COUTURE shall not be liable if a minor under the age of 15 accesses the Site or a User's Account and orders a Product.

3. LEGAL BASIS FOR PROCESSING

MIGAAL COUTURE processes the User's Personal data only on one of the following relevant legal bases:

Necessity: when Processing is necessary to provide the service requested by the User;

In this case, the failure to collect and Process such Personal data may prevent MIGAAL COUTURE from fulfilling the order for the Product(s). The User will not be able to make optimal use of the Site and its functionalities, nor place an order.

For example, delivery details, the Customer's identity or bank details are necessary Personal data.

Delivery details (first name, last name, postal address, e-mail address and telephone number) are transmitted to UPS. Its privacy policy can be consulted at the following link: UPS privacy policy.

Consent: when the User expressly consents to the Processing of his/her Personal data.

In this case, consent will be obtained by the positive act of the User, which consists of checking the box informing him/her of the collection and Processing of his/her Personal data when creating an Account and placing orders.

The User may also subsequently consent or withdraw such consent.

The User's location will be transmitted to the person in charge of making the delivery with the User's name and address in order to identify him/her.

His/her telephone number can also be used to contact him/her and keep him/her informed of any delays in delivery, for example.

Lastly, in order to process payments, MIGAAL COUTURE uses the services of external service providers: STRIPE. The User is invited to consult STRIPE's privacy policy in order to find out how his or her Personal data will be used during payment: STRIPE Privacy Policy.

Legitimate interest: Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, unless prevails the interests or fundamental rights and freedoms of the person concerned which requires protection of personal data, in particular where the person concerned is a minor.

This includes, for example, Personal data that will be collected and processed when you contact MIGAAL COUTURE.

4. RETENTION PERIOD FOR PERSONAL DATA

In compliance with legal obligations, Personal data communicated to MIGAAL COUTURE is kept for the time necessary to achieve the purposes of the Processing described in this Privacy Policy.

Personal data is then archived in order to comply with the statutory limitation and retention periods. It will then be deleted.

If a User Account is inactive for more than one year, it will be suspended and the Personal data will be anonymized.

5. RIGHTS OF THE USER (NATURAL PERSON)

The User concerned by the Processing of Personal data benefits from a right of opposition that may be exercised at any time by contacting MIGAAL COUTURE under the conditions defined below. Should this right be exercised, the User will no longer be able to access the functionalities of the Site requiring the Processing of his/her data.

The User also has the right to access, rectify, delete and limit his or her Personal data, enabling him or her in particular to access information concerning him or her and to demand that his or her Personal data be, as the case may be, rectified, completed, updated or deleted.

The User may also withdraw consent at any time, without such withdrawal having any retroactive effect.

The User also benefits from a right to portability allowing him/her to, in particular, recover the Personal data concerning him/her and processed by MIGAAL COUTURE, for his/her personal use and/or to transfer them to a third party.

And, the User also benefits from the right to define guidelines concerning to the fate of his/her Personal data after his/her death, in accordance with Law n° 78-17 of January 6, 1978 relating to information technology, files and freedoms ("the Data Protection Act").

Any questions or requests relating to Processing of Personal data should be sent electronically to: contact@migaal.com.

The User must indicate in his/her request his/her name, first name, postal address and email address and provide MIGAAL COUTURE with a copy of an identity document so that MIGAAL COUTURE can verify his/her identity.

MIGAAL COUTURE has a response period of two (2) months from the date of receipt of the User's request.

In the event that personal information relating to a minor User has been collected, the minor's legal representative may contact MIGAAL COUTURE in order to access, rectify, complete, update or delete this data under the same conditions as those set out in Article 5 of this Privacy Policy.

6. DATA CONTROLLER

Personal data are processed by MIGAAL COUTURE:

7. PROCESSING RECIPIENT

Personal data may be communicated to MIGAAL COUTURE's Suppliers and partners in charge of providing the services, Processing and managing and processing the payment of orders. MIGAAL COUTURE ensures that these third parties provide the same sufficient guarantees with regard to the implementation of appropriate technical and organizational measures, so that Processing meets the requirements of applicable regulations.

MIGAAL COUTURE informs the User that in order to process the Order(s) it uses the following service providers:

8. SECURITY OF PERSONAL DATA

MIGAAL COUTURE undertakes to ensure the security of User Personal data by implementing physical, electronic and administrative technical protection measures proportionate to the risks incurred and in compliance with applicable regulations.

MIGAAL COUTURE cannot be held responsible for the risks associated with the operation of the User's internet network. It is the User's responsibility to ensure that the appropriate security measures are in place.

In the event of unauthorized access to its personal Account by a third party, the User must inform MIGAAL COUTURE as soon as possible by email at the following address: contact@migaal.com.

9. PRIVACY POLICY UPDATE

MIGAAL COUTURE reserves the right to update this Privacy Policy at any time without notice.

Any changes to this Privacy Policy will be posted on the Site. In the event of significant changes, MIGAAL COUTURE will notify Users and seek their consent if necessary and relevant to the purpose of the Personal data collection.

When using the Site, the User is required to regularly refer to the latest applicable Privacy Policy.

10. APPLICABLE LAW AND CLAIMS

The law applicable to this Privacy Policy is French law.
